At the same time, Germany\u2019s long-term climate protection and emissions reduction targets remain in place.<\/p>\n<p><b>Greater freedom when choosing a heating system<\/b><\/p>\n<p>One of the key changes concerns the previous requirement that new heating systems should generally obtain at least 65% of their energy from renewable sources.<\/p>\n<p>Under the new legislation, this uniform requirement has been removed. Property owners can choose the heating technology that best suits their individual building. Depending on the circumstances, this may include heat pumps, district heating, biomass or hybrid systems. Under certain conditions, gas or oil heating systems may also continue to be used.<\/p>\n<p>The aim is to make modernisation decisions more closely reflect the actual circumstances of individual buildings. This is particularly relevant for existing properties, where technical conditions, costs and available infrastructure can vary considerably.<\/p>\n<p><b>Climate protection requirements remain<\/b><\/p>\n<p>Greater flexibility does not mean that fossil fuels can be used without restrictions.<\/p>\n<p>Stricter requirements for heating fuels will be introduced gradually. From 2029, the required share of climate-friendly or biogenic fuels is expected to increase. By 2045, heating systems are expected to operate on climate-neutral fuels.<\/p>\n<p>For property owners, this means that the decision to replace a heating system should not be based solely on the current purchase price. Future legal requirements, operating costs and the development of local energy infrastructure may also become important factors.<\/p>\n<p><b>What does this mean for landlords?<\/b><\/p>\n<p>The new rules are also relevant to residential leases. The legislation aims to prevent tenants from facing disproportionately high additional costs as a result of inefficient heating systems.<\/p>\n<p>Landlords should therefore consider modernisation projects as a whole. In addition to technical requirements, issues such as the allocation of costs, potential rent adjustments and the economic efficiency of the planned measures may need to be assessed.<\/p>\n<p><b>What should property owners consider now?<\/b><\/p>\n<p>Anyone currently planning to replace a heating system or carry out a larger building modernisation project should not base the decision solely on the increased freedom of choice.<\/p>\n<p>Among other things, it is advisable to consider:<\/p>\n<ul>\n<li>the building\u2019s current energy efficiency;<\/li>\n<li>local heating and municipal heat planning;<\/li>\n<li>the long-term availability and cost of the chosen energy source;<\/li>\n<li>potential government funding;<\/li>\n<li>the impact of modernisation on tenants and existing lease agreements; and<\/li>\n<li>future legal requirements.<\/li>\n<\/ul>\n<p>Government funding for heating replacement and energy-efficient building modernisation remains available, although the applicable funding conditions have been amended. The new funding rules have been in force since 21 July 2026.<\/p>\n<p><b>Conclusion<\/b><\/p>\n<p>The new Building Modernisation Act gives property owners greater flexibility in choosing heating technologies, but it does not remove the long-term requirements for reducing emissions and achieving climate neutrality.<\/p>\n<p>For property owners and businesses, this means <b>more choice, but also a greater need for careful legal and economic planning when investing in real estate<\/b>.<\/p>\n<p>For larger construction or modernisation projects, it can be advisable to assess the legal implications at an early stage \u2014 particularly where energy law, tenancy law, construction law or public-law permits are also involved.<\/p>","protected":false},"excerpt":{"rendered":"<p>Since the end of July 2026, new rules for building modernisation have been in force in Germany.
